A road map of AI regulation in Ukraine

The Expert Committee on the Development of Artificial Intelligence, in close cooperation with the Ministry of Digital Transformation of Ukraine, developed and presented a roadmap for the regulation of artificial intelligence in Ukraine.

The working group of the Committee held a series of meetings to discuss the AI regulation strategy, which involved representatives of business, education, science, NGOs, and the parliament. After considering several strategy options, taking into account global trends, especially those of the European Union, where the AI Act is expected to be adopted next year, the Committee developed a roadmap for AI regulation.

It is based on a bottom-up approach, whereby a significant initiative is given to representatives of business and public organizations to introduce self-regulation. As a result, Ukrainian businesses developing and applying AI technologies are expected to become more competitive and gain access to global markets.

An important emphasis of the roadmap is attention to the rights of Ukrainians in the digital space and to the personal data of Ukrainian citizens.

The roadmap for AI regulation is based on the following principles:

– Service function. Before introducing legally binding regulation, we aim to provide businesses with tools to prepare for the future Ukrainian law and to enter the EU market

– Balance. We do not want to be among the first to introduce regulation but rather wait for the results of similar initiatives in other countries (we learn from other people’s mistakes).

– Partnership and self-regulation. The state and business together. We are building a culture of self-regulation together with the private sector.

– Global perspective. When drafting the law, we consider global realities, in particular, such aspects as the extraterritorial effect of the EU AI Act and the Brussels Effect, as well as the country’s domestic interests.

– Product approach. We provide tools for preparing businesses to enter international markets.

Further steps towards AI regulation in Ukraine include the development of a White Paper with recommendations for (self-)regulation, the launch of a regulatory sandbox, and participation in the HUDERIA pilot project.
